Press Release: John Wiley & Sons Inc. force name change of Edinburgh Fringe show Alan Anderson: Whisky Fir Dummies 2.0
US based publishing house John Wiley & Sons Inc. have forced the name change of one of this year's Edinburgh Festival Fringe shows - "Alan Anderson: Whisky Fir Dummies 2.0", now titled "Alan Anderson: Whisky For Dafties".
In a break from the stance taken by the Recording Industry Association of America (RIAA) and the Motion Picture Association of America (MPIA), earlier this year John Wiley & Sons Inc. the publishers of the "For Dummies" guides, became the first company to begin legal proceedings against individuals for infringing the copyright of its titles by peer to peer sharing of PDF versions of its publications via bittorrent.* They have now turned their attention to a critically acclaimed comedy show at the Edinburgh Festival Fringe.
Scottish comedian Alan Anderson debuted his comedy show "Whisky Fir Dummies" in 2011 at the Edinburgh Festival Fringe where it received rave reviews. He is due to perform a sequel "Whisky Fir Dummies 2.0" at this year's Fringe.
Like the origins of whisky itself, much of the terminology in the show is from the Scots Gaelic language. In Scots Gaelic the show title means "Whisky, man pacifier". The show - where the audience get to sample six single malt whiskies - takes an irreverent look at the Scotch whisky industry, its history, its production and how it effects Scottish culture.
John Wiley & Sons Inc. lawyers accused Anderson's show of "passing off" and claimed it was "likely to result in serious confusion and result in the dilution of Wiley's trademarks".
Anderson replied "The legal advice given is that the show title does not infringe Wiley's "For Dummies" trademark, nor do any of their UK/EU trademark registrations cover the fields of live whisky tasting or stand up comedy. However as an act of goodwill towards Wiley's - and to prevent a lengthy and costly legal battle - it was decided to change the show title. This also opens up the possibility of publishing a series of books, CD or DVD of the show titled "Whisky For Dafties" or better still "Copyright Law For Dafties". Sadly however the name change means that the Edfringe.com URL has been changed making it difficult for customers to purchase tickets for the show online"

It started with the burger chain McDonald's and now it's Wiley's trying to stop the people of Edinburgh from enjoying the delights of free Single Malt Scotch whisky. I thought that was the job of Nicola Sturgeon and her minimum pricing for alcohol policy."
"As for causing confusion or passing off, if you think a large corporation like Wiley's would put on a whisky tasting show in the basement of an Edinburgh student pub at 9pm during the Fringe then you probably need to read Marketing For Dummies. If having seen the show you still think Wiley's is responsible then you should probably write How to produce an award winning Edinburgh comedy show for Dummies"
